TERMS & CONDITIONS
Effective Date: 18 August 2026
These Terms & Conditions govern participation in the Artsy Foundation Kolkata Exhibition 2026, including exhibition participation, artwork submission, workshops, registration, payments, promotion and related activities.
By registering for, submitting artwork to, attending, or otherwise participating in the event, you acknowledge that you have read, understood and agreed to these Terms & Conditions.
1. About the Exhibition
Artsy Foundation Kolkata Exhibition 2026 is an organised art exhibition featuring Ceramic, Textile and Painting, along with a special Alpona Workshop with Sudhir Ranjan Mukherjee.
The exhibition is organised by Artsy Foundation and may involve participating artists, workshop participants, sponsors, partners, volunteers, curators and event staff.
2. Eligibility
Participation is open to eligible artists and creators who meet the requirements announced by Artsy Foundation.
Participants must provide accurate and complete information during registration.
Artsy Foundation reserves the right to verify submitted information.
Submission of an application does not guarantee selection.
The organisers may refuse participation where an applicant does not meet the applicable requirements.
3. Registration
Participants must complete the official registration process within the announced registration period.
Each participant is responsible for ensuring that all submitted information is accurate.
Registration is considered complete only after all required information and applicable fees have been received and verified.
Participants should retain their registration/payment confirmation for future reference.
Registration deadlines may be extended or modified at the sole discretion of Artsy Foundation.
Late registrations may be accepted only where the organisers have expressly announced an extension.
4. Registration & Participation Fees
Applicable registration, participation or workshop fees will be clearly communicated before payment.
Fees may differ according to the category of participation.
Participants are responsible for paying the correct fee within the specified payment period.
Any applicable taxes, payment-processing charges or other charges will be communicated where relevant.
Payment does not automatically guarantee artwork selection or exhibition placement unless expressly stated otherwise.
5. Refund & Cancellation
Registration and participation fees are generally non-refundable once payment has been successfully processed.
Refunds may be considered where:
Artsy Foundation cancels the event;
Artsy Foundation expressly announces a refund policy; or
a refund is required under applicable law.
If a participant voluntarily withdraws after registration, the fee will ordinarily not be refunded.
Failure to submit artwork within the required deadline may result in cancellation of participation without refund.
Any approved refund will be processed through the applicable payment method or another method determined by Artsy Foundation.
6. Artwork Submission
Submitted artwork must be original and created by the participating artist.
Participants must have the necessary rights and permissions to exhibit their work.
Participants must provide accurate details regarding the title, medium, dimensions, artist name and other requested information.
Artwork must comply with the technical and category requirements communicated by Artsy Foundation.
Damaged, incomplete, unsafe or improperly prepared artwork may be refused.
Artsy Foundation reserves the right to reject or remove an artwork where reasonably necessary for artistic, legal, safety or operational reasons.
7. Intellectual Property & Copyright
Participants retain ownership and copyright of their original artwork unless otherwise agreed in writing.
Participants confirm that their submitted work does not knowingly infringe another person’s copyright, trademark, design rights or other intellectual property rights.
Participants are solely responsible for obtaining permissions for third-party material incorporated into their artwork.
Any copyright or ownership dispute arising from an artwork will be the responsibility of the relevant participant.
Artsy Foundation may remove an artwork if it receives a credible intellectual-property complaint or becomes aware of a potential infringement.
8. Selection & Curation
Artsy Foundation may appoint a jury, curatorial panel or selection committee.
Selection may consider artistic quality, originality, concept, execution, relevance and available exhibition space.
The organisers reserve the right to determine the final placement and presentation of selected works.
Selection decisions are final, subject to applicable law.
Artsy Foundation is not obligated to provide individual reasons for every selection or rejection.
9. Exhibition Display
Artists must comply with all installation and display requirements.
Artists are responsible for providing any special mounting, support or display equipment unless otherwise agreed.
The organisers may adjust artwork placement to maintain the overall exhibition design, visitor flow and safety.
Artists must not remove, relocate or alter exhibited works without prior approval.
Any artwork requiring special handling must be disclosed to Artsy Foundation before installation.
10. Ceramic, Textile & Painting Works
Ceramic
Ceramic works must be structurally stable and safe for public display. Artists must disclose fragile, sharp, heavy or otherwise hazardous elements.
Textile
Textile works must be clean, finished and suitable for installation. Artists must communicate any special hanging, suspension or conservation requirements.
Painting
Paintings must be properly finished and prepared for display. Where framing is required, participants must follow the dimensions and framing requirements announced by Artsy Foundation.
11. Alpona Workshop
The event may include a special Alpona Workshop conducted by Sudhir Ranjan Mukherjee.
Workshop registration may be separate from exhibition registration.
Workshop seats may be limited.
Participants must follow the instructions of the workshop facilitator and event team.
Workshop materials may be supplied by Artsy Foundation where specifically stated.
Participants must use workshop materials responsibly and maintain a clean and safe working environment.
Workshop registration fees, where applicable, are subject to the event’s stated cancellation and refund policy.
12. Artwork Sales
Artwork may be offered for sale only where Artsy Foundation has permitted sales as part of the exhibition.
Artists must provide accurate artwork prices and sales information.
Any applicable commission, service fee, tax or payment-processing charge will be communicated before participation.
Artists remain responsible for any taxes or legal obligations applicable to their artwork sales.
Artsy Foundation may establish procedures for recording sales, collecting payments and transferring proceeds to artists.
13. Photography, Video & Promotional Rights
By participating in the exhibition, participants acknowledge that the event may be photographed and filmed.
Participants grant Artsy Foundation permission to use photographs and video recordings of:
their exhibited artwork;
their participation in the event;
workshop and exhibition activities; and
general event scenes in which they may appear,
for legitimate promotional, educational, archival and documentation purposes.
Such material may appear on Artsy Foundation’s website, social media platforms, brochures, posters, press releases, advertisements and future promotional materials.
Where reasonably practical, artists will be credited when their artwork is specifically featured.
14. Personal Information
Information collected during registration may be used for event administration, participant communication, artwork identification, certificates, logistics and legitimate promotional purposes.
Participants are responsible for providing accurate contact information.
Artsy Foundation will handle personal information in accordance with its applicable Privacy Policy and applicable law.
Participants should contact Artsy Foundation if they need to update their registration information.
15. Artwork Transportation & Collection
Unless otherwise stated, artists are responsible for transporting their artwork to and from the exhibition venue.
Artwork must be properly packed for transportation.
Artists must collect their works within the announced collection period.
Special delivery or transportation services may be subject to additional charges.
Participants should arrange appropriate insurance for valuable or particularly fragile artwork where necessary.
16. Damage, Loss & Liability
Artsy Foundation will take reasonable care of artworks while they are under its direct control.
Participants acknowledge that exhibition and transportation environments carry inherent risks, particularly for fragile works.
Participants are responsible for providing accurate handling and installation instructions.
Artsy Foundation will not be responsible for losses arising from circumstances beyond its reasonable control.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
17. Participant Conduct
All participants must behave professionally and respectfully.
The following are prohibited:
harassment or intimidation;
violence or threats;
discrimination;
deliberate damage to property;
disruptive behaviour;
unauthorised removal or alteration of artwork;
unlawful activity; and
conduct that creates a significant safety risk.
Artsy Foundation may remove or disqualify a participant who seriously breaches these requirements.
18. Prohibited Artwork
Artsy Foundation may refuse artwork that:
is unlawful;
infringes third-party rights;
creates a significant safety risk;
contains prohibited or unlawful material;
is deliberately defamatory or unlawfully discriminatory; or
otherwise presents a serious legal, operational or reputational risk to the event.
Artistic, cultural and social commentary will be considered within the boundaries of applicable law and the requirements of the exhibition venue.
19. Changes to the Event
Artsy Foundation reserves the right to make reasonable changes to:
exhibition dates;
venue arrangements;
programme schedules;
workshop timings;
participating artists;
event format;
installation arrangements; or
other operational details.
Changes may be necessary due to venue availability, public safety, government requirements, technical issues, force majeure or circumstances beyond reasonable organisational control.
Where reasonably possible, participants will be informed of significant changes through official communication channels.
20. Force Majeure
Artsy Foundation will not be considered in breach of these Terms & Conditions where performance is prevented or materially affected by circumstances beyond its reasonable control, including natural disasters, severe weather, government restrictions, public emergencies, strikes, venue closure, technical failures or other unforeseen circumstances.
21. Disqualification
Artsy Foundation may cancel or suspend a participant’s participation where the participant:
provides materially false information;
submits unauthorised or plagiarised artwork;
fails to comply with exhibition requirements;
seriously breaches these Terms & Conditions;
engages in misconduct; or
creates a significant legal or safety risk.
Where disqualification occurs because of participant misconduct or a material breach, registration or participation fees will ordinarily not be refunded, subject to applicable law.
22. Communication
Official information regarding registration, deadlines, artwork submission, payments, venue arrangements and programme updates will be communicated through channels designated by Artsy Foundation.
Participants are responsible for checking the contact information and official communication channels provided during registration.
23. Amendments
Artsy Foundation may update these Terms & Conditions when reasonably necessary.
The latest version published or communicated by Artsy Foundation will apply to participation, subject to applicable law and any rights already accrued by participants.
24. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by the applicable laws of India.
Subject to applicable law, disputes arising in connection with the exhibition or these Terms & Conditions shall be subject to the appropriate courts and legal authorities having jurisdiction over the relevant matter and location.
25. Acceptance
By submitting a registration application, making an applicable payment, submitting artwork, registering for the workshop, or participating in the Artsy Foundation Kolkata Exhibition 2026, the participant confirms that they:
have read and understood these Terms & Conditions;
agree to comply with the exhibition rules;
confirm that the information submitted is accurate;
accept the applicable registration and participation requirements; and
acknowledge Artsy Foundation’s right to administer the exhibition in accordance with these Terms & Conditions.
